Les renseignements personnels sont confidentiels. Sauf exception, ils ne peuvent \u00eatre communiqu\u00e9s sans le consentement de la personne concern\u00e9e.<\/span><\/p>\n<p class=\"MsoNormal\"><span lang=\"FR\"><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/P-39.1\"><strong>La Loi sur la protection des renseignements personnels dans le secteur priv\u00e9<\/strong><\/a> (Loi sur le priv\u00e9) a \u00e9t\u00e9 modernis\u00e9e. PLANIFIER LA PROTECTION DES RENSEIGNEMENTS PERSONNELS\n            <\/h2>\n        <\/div>\n                    <div class=\"l-grid__block\">\n            <div class=\"c-typography  c-typography--paragraph-size\" style=\"--typography-paragraph-font-size: var(--font-size-180); --typography-max-width: 100%;\">\n    <p class=\"MsoNormal\"><strong><span lang=\"FR\">\u00c9tablir et mettre en \u0153uvre des politiques et des pratiques<\/span><\/strong><\/p>\n<p class=\"MsoNormal\"><span lang=\"FR\">\u00c0 partir du 22 septembre 2023, les entreprises devront notamment:<\/span><\/p>\n<ul>\n<li class=\"MsoNormal\"><span lang=\"FR\">\u00c9tablir et mettre en \u0153uvre des politiques et des pratiques qui encadrent la gouvernance des renseignements personnels et assurent leur protection. Celles-ci devront, entre autres, pr\u00e9voir :<\/span><\/li>\n<li class=\"MsoNormal\"><span lang=\"FR\">les r\u00f4les et les responsabilit\u00e9s des membres du personnel tout au long du cycle de vie des renseignements personnels d\u00e9tenus par l\u2019entreprise;<\/span><\/li>\n<li class=\"MsoNormal\">un processus de traitement des plaintes relatives \u00e0 la protection des renseignements personnels;<\/li>\n<li class=\"MsoNormal\">des r\u00e8gles applicables \u00e0 la conservation et \u00e0 la destruction des renseignements personnels;<\/li>\n<li class=\"MsoNormal\">Publier sur leur site Web en termes simples et clairs de l\u2019information d\u00e9taill\u00e9e au sujet de leurs politiques et de leurs pratiques. Si l\u2019entreprise ne poss\u00e8de pas de site Web, l\u2019information doit \u00eatre rendue accessible par tout autre moyen appropri\u00e9.<\/li>\n<\/ul>\n<p><strong>Effectuer une \u00e9valuation des facteurs relatifs \u00e0 la vie priv\u00e9e<\/strong><\/p>\n<p class=\"MsoNormal\"><span lang=\"FR\">Depuis septembre 2022, les entreprises doivent proc\u00e9der \u00e0 <a href=\"https:\/\/www.cai.gouv.qc.ca\/espace-evolutif-modernisation-lois\/thematiques\/evaluation-facteurs-relatifs-vie-privee\/\">une \u00e9valuation des facteurs relatifs \u00e0 la vie priv\u00e9e (\u00c9FVP)<\/a> avant de communiquer des renseignements personnels sans le consentement des personnes concern\u00e9es, <a href=\"https:\/\/www.cai.gouv.qc.ca\/communication-renseignements%20personnels-sans-consentement-fins-recherche\/\">\u00e0 des fins d\u2019\u00e9tude, de recherche ou de production de statistiques<\/a>.<\/span><\/p>\n\n<\/div>\n        <\/div>\n    <\/main>\n                                <\/div>\n    <\/div>\n<\/section>\n\n\n    \n\n\n\n\n\n\n\n\n\n\n\n\n\n<section data-module='m03a' class=\"md:u-pt-fl m-content m-content--image-double   u-bg-[var(--module-background-color)] \" style=\"--module-background-color:var(--color-root-white); --typography-max-width: 100%;\">\n    <p class=\"MsoNormal\">L\u2019\u00e9valuation des facteurs relatifs \u00e0 la vie priv\u00e9e (\u00c9FVP) est une d\u00e9marche pr\u00e9ventive visant \u00e0 mieux prot\u00e9ger les renseignements personnels et \u00e0 mieux respecter la vie priv\u00e9e des personnes physiques.<\/p>\n<p class=\"MsoNormal\"><span lang=\"FR\">Ces facteurs sont :<\/span><\/p>\n<ol>\n<li class=\"MsoNormal\"><span lang=\"FR\">La conformit\u00e9 \u00e0 la l\u00e9gislation applicable \u00e0 la protection des renseignements personnels et le respect des principes qui l\u2019appuient;<\/span><\/li>\n<li class=\"MsoNormal\"><span lang=\"FR\">L\u2019identification des risques d\u2019atteinte \u00e0 la vie priv\u00e9e engendr\u00e9s et l\u2019\u00e9valuation de leurs impacts;<\/span><\/li>\n<li class=\"MsoNormal\"><span lang=\"FR\">La mise en place de strat\u00e9gies et de mesures de s\u00e9curit\u00e9 pour \u00e9viter ces risques ou les r\u00e9duire efficacement.<\/span><\/li>\n<\/ol>\n<p class=\"MsoNormal\"><span lang=\"FR\">Elle consiste donc \u00e0 consid\u00e9rer tous les facteurs qui auront un impact positif ou n\u00e9gatif pour le respect de la vie priv\u00e9e des personnes concern\u00e9es. <\/span>Ce processus vise d\u2019abord \u00e0 prot\u00e9ger les personnes physiques concern\u00e9es par ces renseignements.<\/p>\n<p class=\"MsoNormal\"><span lang=\"FR\">Ainsi, l\u2019\u00e9valuation des facteurs relatifs \u00e0 la vie priv\u00e9e permet d\u2019\u00e9viter des probl\u00e8mes que causerait une gestion inad\u00e9quate (plaintes, incidents de confidentialit\u00e9, poursuites judiciaires, atteinte \u00e0 l\u2019image, etc.).<\/span><\/p>\n<p class=\"MsoNormal\"><strong><span lang=\"FR\">\u00c0 compter du 22 septembre 2023, les entreprises devront \u00e9galement effectuer une \u00c9FVP :<\/span><\/strong><\/p>\n<ul>\n<li class=\"MsoNormal\"><span lang=\"FR\">Pour tout projet d\u2019acquisition, de d\u00e9veloppement et de refonte de syst\u00e8me d\u2019information ou de prestation \u00e9lectronique de services impliquant des renseignements personnels;<\/span><\/li>\n<li class=\"MsoNormal\"><span lang=\"FR\">Avant de communiquer un renseignement personnel \u00e0 l\u2019ext\u00e9rieur du Qu\u00e9bec.<\/span><\/li>\n<\/ul>\n<p class=\"MsoNormal\"><span lang=\"FR\">D\u00e8s le d\u00e9but d\u2019un projet, le Responsable doit participer aux consultations entourant l\u2019\u00c9FVP. R\u00e9agir en cas d&#8217;incident de confidentialit\u00e9\n            <\/h2>\n\n                                        \n\n\n\n\n\n\n\n\n\n\n\n\n<div class=\"c-typography  u-mt-6 c-typography--paragraph-size\" style=\"--typography-paragraph-font-size: var(--font-size-180); --typography-max-width: 100%;\">\n    <p class=\"MsoNormal\"><span lang=\"FR\">Un incident de confidentialit\u00e9 correspond \u00e0 tout acc\u00e8s, utilisation ou communication non autoris\u00e9s par la loi d\u2019un renseignement personnel, de m\u00eame qu\u2019\u00e0 la perte d\u2019un renseignement personnel ou \u00e0 toute autre atteinte \u00e0 sa protection.<\/span><\/p>\n<p class=\"MsoNormal\"><span lang=\"FR\">Par exemple, un incident de confidentialit\u00e9 pourrait se produire lorsque :<\/span><\/p>\n<ul>\n<li class=\"MsoNormal\"><span lang=\"FR\">un membre du personnel consulte un renseignement personnel sans autorisation;<\/span><\/li>\n<li class=\"MsoNormal\"><span lang=\"FR\">un membre du personnel communique des renseignements personnels au mauvais destinataire;<\/span><\/li>\n<li class=\"MsoNormal\"><span lang=\"FR\">l\u2019entreprise est victime d\u2019une cyberattaque : hame\u00e7onnage, ran\u00e7ongiciel, etc.<\/span><\/li>\n<\/ul>\n<p class=\"MsoNormal\"><span lang=\"FR\">Depuis le 22 septembre dernier, les entreprises doivent suivre un nouveau processus lorsqu\u2019elles ont des motifs de croire que s\u2019est produit un incident de confidentialit\u00e9 impliquant des renseignements personnels qu\u2019elles d\u00e9tiennent.
